Digital Services Privacy Policy and Terms of Use

Thank you for visiting EmblemHealth's website, mobile application, or digital property (collectively known as "the Site").

By visiting and using the Site, you are bound to these Terms of Use unless you have been provided with notice that other more specific terms apply. The Terms of Use ("Terms") is a legal agreement between you (the end user of the Site) and EmblemHealth. By downloading, using, or visiting the Site in any way, whether or not you register or create an account through the Site, you acknowledge that you accept these Terms and understand they may be changed from time to time at the sole discretion of EmblemHealth. If you do not accept the Terms, you are not granted a license to access or use the Site, should not continue to use the Site, and should delete any copies of the Site you have. The Terms are in addition to other agreements you may have with EmblemHealth. Your use of the Site is at all times subject to these Terms.

These Terms do not apply to EmblemHealth's access to or exchange, use, or disclosure of protected health information (PHI) as is defined in the Health Insurance Portability and Accountability Act of 1996 (HIPAA). EmblemHealth will manage all protected health information in accordance with its Notice of Privacy Practices (NPP) .

These Terms tell you what rules generally apply to your use of the Site. Additionally, these Terms include a Site Privacy Policy (see below) that describes generally what information we collect when you visit or use a Site, how we use, share, and disclose that information, and your rights with respect to that information. The Site Privacy Policy applies in the absence of other more specific terms that apply to our use of collected information, such as the NPP.

Terms of Use

The Site is not a substitute for medical advice from your doctor or health care professional.
Nothing contained or provided through the Site is intended to be used for medical diagnosis or treatment, nor is it an endorsement by EmblemHealth. Nothing on this Site should be used in place of the advice of your doctor or other health care professional. You should never disregard medical advice or delay seeking medical advice because of something you read, viewed, or heard on the site. The Site may contain content that is provided under license from third parties and is maintained by them. EmblemHealth offers that content solely for your education and makes no representation or warranty of its accuracy. You agree to hold EmblemHealth and third-party licensors of that content harmless from any claim or harm that may result from your access to this copyrighted material.

The Site is for your noncommercial personal use.
EmblemHealth makes the Site available for your lawful, noncommercial, personal use. It offers general information for educational purposes only and, subject to these Terms, grants you a limited, revocable, nonexclusive license to visit and use the Site for your noncommercial use. No part of the Site may be reproduced or otherwise used for commercial purposes without the express written permission of EmblemHealth. You may not use robots, scraping tools, or other automations to visit the Site, test the Site, or collect information from or about the Site.

Disclaimer of warranties and limitation of liability
EmblemHealth makes no representations or warranties about the suitability of the Site for any particular purpose. EmblemHealth assumes no responsibility for any loss or harm that occurs resulting from your use of the Site. Your use of the Site is solely at your own risk. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply in all jurisdictions or to you.

This site is provided by EmblemHealth on an "as is" and "as available" basis, and without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. EmblemHealth does not warrant the accuracy or completeness of any information contained on the site. EmblemHealth does not warrant that the site is secure or free from viruses or other harmful components. EmblemHealth is not responsible for the technology you use to visit the site, how your technology interacts with the site, or what information may be disclosed by your technology to third parties as a result of you visiting the site.

The information contained on the site is not confidential and it does not establish a treatment relationship.

To the maximum extent permitted by applicable law, under no circumstances shall EmblemHealth or its third party vendors be liable to you for any direct, indirect, punitive, exemplary, incidental, special, or consequential damages, fees, fines, penalties, loss of revenue or business, or liabilities that result from the use of, or inability to use the site and/or content or information provided on or through the site.

By using or visiting the site, you acknowledge and agree that your sole and exclusive remedy for dissatisfaction with the site is to stop using it.

Applicable law and jurisdiction
You agree that the Terms and any dispute arising from or relating to the Terms or the Site Privacy Policy shall be governed and interpreted in accordance with the laws of New York state, excluding conflict-of-law rules. You also agree that any legal action arising from these provisions must be brought in a state or federal court located in New York state. In addition, you consent to the personal jurisdiction and venue of these courts.

Additional terms
The Site includes content developed by EmblemHealth as well as content provided by third parties. The Site may contain links to other websites or applications that are outside of EmblemHealth’s control. As a result, we may require you to sign in or authenticate your identity or accept additional terms of use. The additional terms will supersede, modify, or supplement these Terms. If the content is provided by a third party, EmblemHealth assumes no responsibility for it and you acknowledge that EmblemHealth is not responsible for its accuracy.

Copyright and trademark information
The Site, including all software and content, is the property of EmblemHealth or its licensors and is protected by copyright and other intellectual property laws. The EmblemHealth logo is a registered trademark of EmblemHealth. The product and service names on the Site are proprietary marks of EmblemHealth. All other brands and names are the property of their respective owners.

We comply with the Digital Millennium Copyright Act
If you have any copyright concerns about materials or content posted on the Site, you agree to let EmblemHealth know. Pursuant to Title 17, United States Code, Section 512(C)(2), notifications of claimed copyright infringement should be sent to EmblemHealth's Designated Agent using the Contact Us section below. It should contain:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work or works claimed to have been infringed.
  • A description of the material alleged to be infringing or involved in infringing activity, including enough detail to allow the service provider to locate the material and remove it or disable access to it.
  • Contact information of the complaining party such as an address, telephone number, and an email address.
  • A statement that the complaining party, in good faith, believes that use of the material in the manner described is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Children under 13
In compliance with the Children’s Online Privacy Protection Act ("COPPA"), this website ("Site") is not intended to be used by children under 13 years old. We do not allow children under age 13 to publicly post any information on this Site.  We do not knowingly collect information from or direct our Site to children under age 13.  Under our Terms of Use, Users must represent and warrant that they are at least 18 years of age. Children ages 13 and over may only use our Site if they represent and warrant that they are permitted by law to access this Site.  If we discover that the Site is being accessed or used inappropriately, we will disable the user ID so that the individual may no longer access our Site.  If you have concerns about access to this site, please Contact Us.

Changes to these Terms
EmblemHealth may change these Terms from time to time. When material updates are made, the Policy version date will also be updated to reflect that a revision occurred. We encourage you to periodically re-read these Terms to see if there have been any changes that may affect you. A user is bound by any changes to these Terms when you use the Site after such changes have been first posted.

Conversational artificial intelligence (AI) tools privacy notice
The following notice is intended to inform you about our data collection practices regarding conversational AI tools ("Tool"). Please read this notice carefully before engaging with the Tool. The Tool may be presented to you with links to additional information or terms regarding the Tool. In those cases, the links are specific to the tool and govern if a conflict with the Terms or the Site Privacy Policy.

  • General information: The Tool may be powered by our third-party vendors. It is designed to provide information and assistance on the Site.
  • Collection of personal information: Personal information collected through your use of the Tool will be disclosed to third-party service providers whom are prohibited from using your data for any purpose other than to handle your inquiry and improve the Tool services offered to you and other users, including training the underlying AI model.
  • AI functionality: The Tool is powered by AI systems. We strive to provide accurate information, but as with any AI technology there is the potential for errors. Therefore, we cannot guarantee the accuracy, completeness, or up-to-date nature of the information provided.
  • User responsibility: You bear sole responsibility for your interactions and reliance on the output of the Tool. It is important to exercise caution and use your discretion while interpreting and acting upon the Tool’s responses. Neither us nor our third-party vendors can be held liable for any actions, losses, or damages resulting from the use of the Tool.

Site Privacy Policy

What does this Privacy Policy cover?
This Privacy Policy describes how EmblemHealth collects, uses and discloses information we collect from you as a result of your use of the Site such as your name, email address, IP address, or other unique identifiers ("Personal Information"). This Privacy Policy applies in the absence of more specific terms or a legal requirement. If Personal Information is also protected health information (PHI) as defined by Health Insurance Portability and Accountability Act of 1996, it is subject to our Notice of Privacy Practices (NPP). Examples of PHI include your name, address, birth date, Social Security number, and medical records (diagnoses, treatments, lab results, and medicines). The NPP describes how we use and disclose PHI and also contains information about how you can obtain the information contained in a designated record set.

This Privacy Policy does not apply to information that has had identifiers removed or other actions taken so that you are no longer identified in the data (also called de-identified data). For example, identifiers such as your name, date of birth, or other revealing elements may be removed from the data. EmblemHealth may use and share any de-identified data with third parties for any purposes permitted by applicable law for EmblemHealth or third-party operations, research, or development or provision of services.

How do we collect Personal Information?
We automatically collect certain information from your device when you visit the Site. This information may include:

  • Your device, such as its IP address, type of device you use when visiting the Site as well as the operating system and browser(s) used by your device.
  • The date and time you visit the Site.
  • Your device location and/or location of your connection to an internet service provider.
  • Websites and/or links that directed you to our Site.
  • Cookies or other identifying technology that may be used by us directly or indirectly in providing services and this Site to you.

We also collect information that you specifically provide to us. For example, when you fill in forms on our Site; participate in, link, or name EmblemHealth in social media; use apps provided by us; or register for an account or respond to a survey.

How do we use Personal Information?
We use or disclose the information to:

  • Provide you with goods, services, and access to information.
  • Provide you with additional services that we believe may be of interest to you.
  • Make our Site operate and support Site improvements and development.
  • Operate our business.
  • Comply with law.
  • For information gathered through a research survey:
    • We use information for quality improvement purposes, which includes improving information and services offered through the Site.
    • If you provide feedback, you may be contacted for follow-up due to concerns raised in the survey.
    • Demographic information and web log data may be stored for future research and evaluation.

To the extent permitted by law, we may store and use information to contact you for health plan and related services by various means including regular mail, email, telephone (including voicemail), text message, artificial and prerecorded voice, and through the Site. By visiting the Site you agree to be contacted by us and through automated technology. You may receive messages about wellness programs or other programs sponsored by EmblemHealth or its business partners. We may share Personal Information with our affiliated business partners to the extent that they are performing services or providing products on our behalf or as a component of our provision of goods, services, or information to you.

We do not control the policies and practices of third-party websites or businesses regarding privacy or anything else. If you choose to take part in any program or service relating to an affiliated business partner of ours, please review their business or website policies.

Periodic communications
We may receive confirmation when you open an email from us. This confirmation helps us ensure you receive important information; adjust our communications with you to be more relevant; and improve our services. If you opt to have text message notifications sent directly to your cell phone, we receive and store the information you provide, including your telephone number. You can adjust the types of notifications you receive and when you receive them by editing your text message notification settings. We may also use your Personal Information to notify you about payment information and/or to communicate with you about your account.

Payments
If you use a payment card to make payments through the Site, that information may be collected and stored by third-party payment processing companies ("Payment Processors"). Use and storage of that information is governed by the Payment Processor’s applicable terms of service and privacy policy. We may request and receive some of your financial information from our Payment Processor to complete transactions you initiated through the Site; enroll you in discount, rebate, and other programs in which you elect to participate; protect against or identify possible fraudulent transactions; and as needed to manage our business.

Other information such as "cookies" and "tags"
When you use the Site, we collect certain usage data, such as the number of visitors we receive or what pages are visited most often. This data helps us analyze and improve the usefulness of our services. We may also collect or receive information from third parties based on your IP address that provides us your geolocation data in order to identify suspected fraudulent activity, identify relevant markets for users, and to provide a better mobile experience. We do not sell this data; however, we may store, disclose, or use it to deliver advertisements relevant to your relationship with EmblemHealth.

Like most commercial website owners, we may use what is known as cookie technology. A cookie is a piece of data that a website can send to your web browser when you link to that website. By assigning a unique data element to each visitor, the website is able to recognize repeat visitors, track usage patterns, and better serve you when you return to that website. Our cookies do not extract information about you such as your name or address. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our Site’s features.

We may also use what is known as "client-side page tagging," which uses code to write certain information about the page and visitor to a log when a page is displayed by your web browser. This technique is also commonly used on commercial websites. "Tagging" causes a JavaScript program to run on your computer, but it is limited to providing information about the page that you are requesting and the configuration of your browser. It will not read any of your data files or execute any additional programs. It does not extract any information about you such as your name or address. You can prevent tagging by disabling JavaScript in your browser, but that may prevent you from using all of our Site’s functions. Because there is not yet a common understanding of how to interpret the "Do Not Track" signal, we do not currently respond to browser "Do Not Track" signals.

How do we share personal information?
We do not rent or sell your Personal Information to anyone. We may share your Personal Information with third parties as described in this section. EmblemHealth may disclose your Personal Information to our affiliates, subcontractors, partner organizations, and other entities to the extent necessary provide you with products and services. In all cases, we will disclose the information consistent with applicable laws and regulations.

We may choose to buy or sell our assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party, though we will take reasonable steps to ensure that your preferences are followed.

We may retain your information as needed for business purposes. Regardless of anything stated elsewhere, we will retain, access, use and disclose your information when we believe it is necessary to comply with our legal obligations, resolve disputes, enforce our policy and other agreements, or to protect the rights, property or safety of EmblemHealth, our employees, our users, and others. We reserve the right to report to appropriate law enforcement or government agencies activities that we, in good faith, believe to be harmful or unlawful, with or without providing notice to you.

How can you stop receiving emails?
Certain emails we send to you contain an unsubscribe link so you can easily opt-out of receiving future commercial emails from us. If you do not wish to receive certain emails from EmblemHealth, simply click the unsubscribe link and follow the instructions to unsubscribe your email address. If you have unsubscribed but continue to receive email from us or from one of our partners or affiliates, please report this to us and we will investigate and utilize our best efforts to remove you from all lists. Please note that unsubscribe requests may take up to 7 to 10 days to process. Please note that you can opt out of marketing and advertising emails, but we may still send you transactional emails relating to your account for things such as password recovery or payment reminders.

Telephone Consumer Protection Act (TCPA)
If you provide us with your telephone number then you expressly authorize us to contact you via that number for purposes for which you provided that telephone number as well as our ongoing business relationship with you.  If you wish to cancel this authorization, select the opt-out option on any text messages you receive from EmblemHealth or contact us.

Security
EmblemHealth has adopted and adheres to stringent security standards designed to protect nonpublic Personal Information collected on the Site against accidental or unauthorized access or disclosure. Among the safeguards that EmblemHealth has developed for this Site are administrative, physical, and technical barriers that together form a protective firewall around the information stored at this Site. We periodically subject our Site to simulated intrusion tests and have developed comprehensive disaster recovery plans. For registered users, your account is protected by a password for your privacy and security. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password and other sign-on mechanisms appropriately and limiting access to your computer or device and browser. We try to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. Your login credentials are yours alone and should not be shared with anyone, even a family member, for any reason. If we detect the shared use of an account, we may disable that account for security reasons.

What personal information can I view and update?
In some cases, if you are a registered user, you will be able to change your password and update the information that you provide to us, such as your address, contact information, and health information, by going to the profile page of your account on the Site. In other cases, you may need to contact your benefit administrator, or the appropriate state or federal health insurance marketplace to update your information. You can update cookie settings in your web browser.

The information you can view, update, and delete may change as the Site changes. If you have any questions about viewing or updating information we have on file about you, please contact Customer Service. Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask us for a notice identifying the categories of Personal Information that we share with our affiliates and/or third parties for marketing purposes, and providing contact information for those affiliates and/or third parties. What choices do I have?
You can use certain features of the Site without registering, thereby limiting the types of information that we collect. You can always choose to not disclose information to us, but keep in mind that some information may be needed to register with us or to take advantage of some of our Site's features.

If you have registered for the Site, you may be able to add, update, or delete information in your account as explained above. When you update information, we may maintain a copy of the unrevised information in our records. You may request deactivation of your account by calling Customer Service. Some or all of your information may remain in our records after your deactivation of such information from your account. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete your account, but not in a manner that would identify you personally.

We will share your comments and questions with our Customer Service representatives and those employees most capable of addressing your questions and concerns. Please note that email like all non-encrypted internet email communications, may be accessed and viewed by other internet users while in transit to us without your knowledge and permission. For that reason, to protect your privacy, please do not use email to communicate information to us that you consider confidential. Data Security Policy

At EmblemHealth, safeguarding your information is a top priority. We provide secure access to member, provider, broker, and employer online services through our website and mobile experiences, so you can view and manage information such as claims and other coverage-related details.

Secure access and authentication. Access to personal information through our digital services is restricted to authorized users. Users are required to authenticate using a username and password, and we use multi-factor authentication (MFA) to help protect accounts from unauthorized access.

Encryption and secure connections. When you use our Online Services to view or manage transactions, information is protected using encryption in transit via secure industry-standard protocols (e.g., TLS).

Security program and oversight. Our security controls are designed to help protect sensitive information using layered safeguards and monitoring. Our cybersecurity program is designed to meet applicable requirements under HIPAA and the New York State Department of Financial Services (NYDFS) cybersecurity requirements.

Independent validation. EmblemHealth’s cybersecurity controls are periodically assessed by independent third parties and aligned to recognized industry standards. We use these assessments to validate key controls and to continuously improve our security posture.
